FACTS OF THE CASE:
Defendant Vergara went to a rival gang member and drug dealer’s house (Ricky Vasquez) who lived in the same neighborhood. Two females at the house watched as Vergara and co-defendant Velasquez loaded property into garbage bags. Velasquez had a firearm and repeatedly told the females to remain quiet. When one of the females tried to escape, Vergara is accused of using a firearm and forcing her back into the bedroom. Vasquez was later shot by Velasquez in the head while pleading for his life. Velasquez was arrested on December 26, 2002 while he was a passenger in a car stop. The officer saw Velasquez reach into the back seat of the vehicle. The officer found the firearm which turned out to be the weapon used in the above murder. Velasquez was tried before a jury in 2004 and convicted of murder.
