As part of the Drug Endanger
ed Children Program (DEC), we prosecuted and convicted a 37-year-old mother for violations of Health and Safety code sections 11379.6(a) (manufacture of methamphetamine), 11379.7 (manufacture of methamphetamine with a child under the age of 16 present), 11383(c) (possession of methamphetamine with intent to manufacture), and Penal Code section 273a(a) (endangering the health of a child). The police were summoned to the defendants apartment by her mother because of concern that she was suicidal and running a methamphetamine lab out of the apartment she shared with her 13-year-old son. Outside the apartment, police were able to smell chemicals used in the manufacture of methamphetamine. Because these chemicals are both highly toxic and combustible, the police evacuated nearby apartments and brought in a lab and DEC team to clear the apartment. The defendant was talked into surrendering herself and admitted that she was manufacturing methamphetamine in the apartment. Inside the police located an operational methamphetamine lab. The defendants 13-year-old son told the police that his mother was manufacturing methamphetamine out of the apartment despite his repeated requests that she stop because the chemicals were making him sick. The son was able to explain to the police the chemical process used in manufacturing methamphetamine as a result of living with his mother. The defendant was sentenced to three years in state prison.
