Two rival gangs had gotten into a scuffle at a drugstore. Outnumbered and unarmed, the defendants left the drugstore. They went home angry and rallied fellow members to seek revenge. Later that day, they piled into a car and went driving into the heart of rival territory flashing gang signs at the people on the street. The rival gang responded to the challenge by suggesting a fight in a nearby alley. Once in the alley, one of the defendants exited from the car and pointed his loaded gun towards the advancing rivals in the alley. The second defendant jumped in front of him and fired his own .22 semi-automatic. One shot hit a fleeing rival gang member in the back, puncturing his heart and killing him. Fullerton Police Department detectives arrested all of the defendants within two weeks of the murder. Two defendants were convicted of second degree murder and received life sentences. The other defendants pleaded guilty to manslaughter and testified at the trial against their fellow gang members.
