The victim was raped in 1999. The case was not solved until 2003 when the OCDA received a DNA cold hit. At trial the victim had difficulty recalling the vicious assault on her by the defendant, who was a stranger and raped her in front of her home as she was returning from the laundry room. The foundation was laid by the prosecutor for reliance on the hearsay exception of past recollection recorded. The police officer who was first on the scene after the victim was raped was able to testify as to her original statements to him. The defendant was convicted of all charges. The defendant is currently serving a 16-year prison sentence.
