Detention Hearing

  •  At the detention hearing, the court will determine whether to release the minor or keep him or her detained in juvenile hall based on the seriousness of the offense, alleged injury to the victim, safety to the public, and the minor’s likelihood of fleeing the court’s jurisdiction.  Minors are entitled to an attorney at all stages of the court process.  Unlike the adult system, minors are not released on bail.  The court can order as a condition of release that the minor not contact the victim.
  • Whether the minor is detained or released, the case is set for a pre-trial and “jurisdiction hearing."
