Juveniles Unfit for Juvenile Court

  • When a minor commits certain serious felony crimes, the District Attorney’s Office may request the Juvenile Court transfer the case to the adult justice system.  The court will look at various factors to determine if the minor is “fit” for juvenile court.  If the court finds the minor “unfit” for juvenile court, then the case is transferred to the adult justice system and the case is prosecuted just like an adult felony case. 

  • In other serious felony cases, the District Attorney’s Office has the option of filing the case directly in adult court and treat the minor as an “adult” in the eyes of the law.

  • In some serious felony cases, the District Attorney is mandated to file the case of the juvenile directly in an adult case and the minor will be deemed an "adult" in the eyes of the law.
